Onsidian LTD (“Onsidian,” “we,” “us,” or “our”) provides a software platform for sales agencies, including tools for activity tracking, reporting, scheduling, recruiting, and team management (the “App”). By accessing or using the App, you agree to these Terms of Service (“Terms”). Our Privacy Policy and Cookie Policy are incorporated into these Terms.

Eligibility and accounts

You must be at least 18 years old to use the App. You agree to provide truthful and accurate information, keep your account credentials secure, and be responsible for all activity that occurs under your account. We may suspend or refuse service at our discretion.

Communications consent

By creating an account or submitting your contact information through the App or one of our recruiting websites, you consent to receive communications from us, including emails, phone calls, and SMS messages, related to your account, your application, or your use of the App. You may opt out of these communications at any time.

SMS and text message communications

Program Name: Onsidian

Program Description: By providing your phone number and opting in, you agree to receive automated text messages from Onsidian. For platform users, these messages include account notifications such as scheduling reminders, appointment confirmations, and activity updates. For job applicants, these messages include application status updates, interview scheduling and reminders, and onboarding communications.

Message Frequency: Message frequency varies based on your account or application activity and communication preferences.

Message and Data Rates: Message and data rates may apply. Please check with your mobile carrier for details.

Opt-Out and Help Instructions: To stop receiving messages at any time, reply STOP to any text message from us. For help or more information, reply HELP or contact us at support@onsidian.com or (775) 890-2699.

Privacy: Your information will be handled in accordance with our Privacy Policy, available at https://onsidian.com/privacy

Carrier Liability Disclaimer: Carriers are not liable for any delayed or undelivered messages.

Third-party disclosure

We do not sell, rent, or share your personal information or phone number with third parties for their own marketing purposes. We may share information with service providers who assist in operating the App and our communications solely on our behalf and subject to confidentiality obligations. Text messaging originator opt-in data and consent will not be shared with any third party.

Acceptable use

You agree not to submit false information, attempt unauthorized access to any part of the App or its systems, copy or distribute App content without permission, or interfere with the App's functionality.

Intellectual property

All content in the App is owned by Onsidian and may not be copied or reused without permission.

Third-party services

We use third-party tools for hosting, messaging, and analytics. We are not responsible for their independent services or policies.

Disclaimer of warranties

The App is provided “as is” without warranties of any kind.

Limitation of liability

To the fullest extent permitted by law, Onsidian is not liable for indirect, incidental, or consequential damages arising from your use of the App.

Dispute resolution

All disputes shall be resolved by binding arbitration in Nevada. You waive the right to jury trials and class actions.

Changes

We may modify these Terms at any time by posting the updated Terms on the App. Continued use of the App constitutes acceptance of the updated Terms.
